E-CIGS CONFISCATED BY CUSTOMS 01/15/10
RULING ONLY APPLIES TO THOSE COMPANIES LISTED IN THE LAWSUIT
Hi All!
My husband and I have a small e-cig business in Las Vegas, started a few months ago. We knew about the FDA and possible confiscation at customs, however, thought we would take a shot and start our own side business to supplement income. Ordered about 100 or so kits from China (small quantities: 20-30 at a time), got them with no problem.
We were thrilled when we found out the news about the lawsuit won by Smoking Everywhere and NJoy. we figured we would no longer have to worry about our shipments being stopped due to the win in court. Imagine our surprise when we were called by the shipping company, just last week, letting us know that our order had been stopped by customs, then was taken by the FDA!!! At this time the FDA is holding 50 of our kits hostage and is refusing to release our products.
When my husband spoke with the representative at customs, he was told that the ruling only applied to Smoking Everywhere and NJoy and that 80% of all other e-cig orders coming from China are being confiscated by the FDA.
We are really hoping that the lawsuit will open the doors for other companies, otherwise, going forward, the only choices for e-cigs may be these 2 companies. Please understand, we have done our market research and like both of these products, however, a couple of questions remain...why is it ok for some and not for others, how will this affect every other e-cig company in the US, and how deep do your pockets have to be to fight government bureaucracy??? Yeah, I know the last one is a silly question!
We are hopeful for the future of the e-cig and hope this lawsuit will help other companies out there
